Website: www.janepowellartist.co.uk

These Terms and Conditions apply to customers purchasing artwork, prints, cards, commissioned artwork, in-person workshops and online courses. By placing an order, booking a workshop or purchasing an online course, you agree to these Terms and Conditions.

2. General Terms

These Terms and Conditions apply to purchases made through our website, online payment facilities and other agreed methods of sale. Customers are responsible for providing accurate contact, delivery and payment information when placing an order or making a booking. We reserve the right to decline or cancel an order where there is a genuine reason to do so, including suspected fraudulent activity or an error in the advertised price or product description. If payment has already been taken, any refund due will be made using the original payment method.

3. Prices and Payments

All prices are displayed in pounds sterling (£ GBP), unless otherwise stated. Jane Powell Art is not currently registered for UK VAT. UK VAT is therefore not charged separately by the business while this remains the case. Any other applicable taxes, duties or charges arising from an international purchase will be handled in accordance with the relevant tax requirements. Prices may be changed at any time. However, the price applicable to an order will be the price displayed and agreed at the time of purchase. Payment must be made using the payment methods offered or agreed at the time of purchase.

Payments made online are processed through the relevant third-party payment provider. Jane Powell Art does not store or have access to customers' full payment card details.

4. Original Artwork, Prints and Cards

Original paintings, fine art prints, greeting cards and other products are described as accurately as possible, with photographs and product information provided to help customers make an informed purchase.

Please be aware that colours may appear slightly different on individual screens and devices, and printed products may show minor variations in colour and finish. Original artwork is individually created and may naturally include variations in texture, surface and finish. Unless otherwise stated, prints and cards are sold as physical products and will be dispatched to the delivery address provided at checkout.

5. Delivery, Returns and Refunds – Physical Products

Delivery charges and estimated delivery times will be displayed or confirmed before purchase.

Delivery times are estimates and may be affected by postal services, courier delays, customs procedures or other circumstances outside our control. For international orders, customers are responsible for any import duties, customs charges or local taxes that may apply.

Right to cancel

For online purchases of physical goods, customers in the UK generally have a statutory right to cancel within 14 days of receiving their goods, without giving a reason. If you wish to cancel an order, you must notify Jane Powell Art within the applicable cancellation period by emailing info@janepowellartist.co.uk. Once you have notified us of your cancellation, you will normally have a further 14 days to return the goods. Unless the goods are faulty or incorrectly supplied, customers are responsible for the direct cost of returning unwanted items. Refunds will be made in accordance with applicable consumer legislation. Some items may be exempt from the usual right to cancel, including genuinely personalised or bespoke goods made to the customer's specifications.

Faulty or damaged items

If an item arrives damaged, faulty or not as described, please contact us as soon as possible, providing photographs where appropriate. We will work with you to resolve the issue in accordance with your statutory consumer rights.

Nothing in these Terms and Conditions affects your legal rights in relation to faulty, damaged or incorrectly described goods.

6. Commissioned Artwork

Jane Powell Art accepts commissions for original paintings. Each commission is individually discussed and agreed with the customer before work begins.

Quotations and Payment

A written quotation will be provided outlining the agreed artwork, price and estimated completion or delivery date.

To confirm a commission, a deposit of 50% of the agreed price is payable upon acceptance of the quotation. Work will not commence until the deposit has been received. The remaining 50% balance is payable upon completion of the artwork and before collection or dispatch. Any additional costs, including agreed changes to the original brief or additional delivery charges, will be discussed and agreed with the customer before being incurred.

Progress Updates and Changes

Depending on the nature of the commission, Jane may occasionally share sketches or photographs of the artwork while it is in progress. However, progress updates are not guaranteed and will be at Jane's discretion.

The commission will be based on the brief agreed at the outset. Changes to the original brief are not normally accepted once work has commenced. On occasions where Jane chooses to share a progress image and invites feedback, reasonable adjustments may be discussed and agreed. Any significant changes that are agreed may affect the price and estimated completion date.

Cancellation of Commissions

If a customer wishes to cancel a commission, they should contact Jane Powell Art as soon as possible.

Any refund due will take account of the work already completed, materials purchased specifically for the commission and any other reasonable costs or losses arising from the cancellation, subject to applicable consumer protection laws.

The initial 50% payment is not automatically non-refundable in every circumstance. Any refund entitlement will be assessed in accordance with the nature of the agreement and applicable law. Where a commission is cancelled by Jane Powell Art, any refund due will be made in accordance with applicable consumer protection laws.

Completion and Delivery

Estimated completion dates are provided in good faith but may be subject to change due to the nature of creating original artwork. The customer will be notified of any significant anticipated delay. The remaining balance must be paid before the completed painting is dispatched or collected.

Copyright, Ownership and Use of Images

Copyright in all commissioned artwork remains with Jane Powell, unless otherwise agreed in writing.

Purchasing a commissioned painting transfers ownership of the physical artwork to the customer but does not transfer copyright or reproduction rights. Jane Powell retains the right to photograph commissioned landscape paintings and use these images for her portfolio, website, social media and other promotional purposes. She also reserves the right to reproduce commissioned landscape paintings as prints, greeting cards or other products. This permission to use and reproduce images applies to landscape commissions only.

For any commission of a personal or bespoke nature that is not a landscape, Jane Powell will seek the customer's prior permission before using images for promotional purposes or reproducing the artwork commercially.

Customers must obtain written permission from Jane Powell before reproducing commissioned artwork commercially or using it for commercial purposes.

7. In-Person Art Workshops

Jane Powell Art offers in-person painting workshops at various venues. Workshop descriptions, dates, locations, prices and any materials included will be provided when bookings are advertised.

Bookings and Payment

Places on workshops are limited and bookings are confirmed once payment has been received.

Workshop fees must be paid in full at the time of booking, unless otherwise agreed. Customers are responsible for checking the workshop date, location, timings and any materials or equipment they need to bring.

Workshop Cancellation Policy

Places on workshops are limited to a maximum of 10 participants, and preparation and arrangements are made in advance.

Our usual cancellation policy is as follows:

  • More than 14 days before the workshop: A full refund is available if you cancel your booking.

  • Within 14 days of the workshop: Cancellations are normally non-refundable, and payments cannot automatically be transferred to another workshop.

  • If you can no longer attend: Please let Jane know as soon as possible. If the place can be filled by another participant, a refund may be offered at Jane's discretion.

  • Non-attendance: If you do not attend and have not contacted Jane beforehand, your payment is non-refundable.

  • If Jane Powell Art cancels a workshop: You will be offered a full refund.

This cancellation policy is subject to any statutory cancellation rights that apply to your booking. Nothing in this policy removes or limits your legal rights.

Changes to Workshops

We reserve the right to make reasonable changes to workshop arrangements where necessary, including changes to venues, timings or materials. If a significant change is required, customers will be notified as soon as possible.

If Jane Powell Art has to cancel a workshop, customers will be offered a full refund. Workshop fees cannot automatically be transferred to another workshop or exchanged for artwork or other products.

Workshop Participation

Customers are expected to behave respectfully towards other participants and follow any reasonable instructions relating to the safe use of materials, tools and equipment. Any specific health, safety or equipment requirements will be explained where relevant.

8. Online Courses

Jane Powell Art offers self-paced online painting courses, providing recorded tuition, demonstrations and supporting learning materials. The content of each course will be described on its relevant sales page.

Depending on the course, materials may include:

  • Pre-recorded video lessons and painting demonstrations.

  • Downloadable worksheets, notes and reference materials.

  • Practical exercises and painting projects.

  • Additional resources to support learning.

Courses are designed for independent learning and do not include individual tuition, personal feedback, assessment, mentoring or one-to-one support unless specifically stated in the course description.

Prices and Payment

Course prices are displayed in pounds sterling (£ GBP). Payment is required in full at the time of purchase. Courses are sold as a one-off payment unless otherwise stated.

Access to Courses

Following successful payment, customers will receive instructions to access their course through the online learning platform. Access is normally provided shortly after payment has been processed. Customers are responsible for providing a valid email address and keeping their login details secure. Course access is provided to the individual purchaser and must not be shared with anyone else. Courses remain accessible for as long as they continue to be offered and supported by Jane Powell Art. Access is not guaranteed for life or for a specified number of years unless expressly stated on the relevant sales page. Jane Powell Art reserves the right to withdraw or close a course. Where reasonably possible, existing customers will be given advance notice of any planned closure affecting their access. Where access is withdrawn, any applicable statutory rights or remedies will be respected.

Copyright and Permitted Use

All online course materials are the intellectual property of Jane Powell unless otherwise stated.

Purchasing a course gives the customer a personal, non-exclusive and non-transferable right to access and use the materials for private learning.

Customers must not:

  • Copy, reproduce, distribute or share course videos or materials.

  • Record or redistribute video lessons.

  • Download or share materials where downloading has not been specifically provided.

  • Share login details or allow other people to access their account.

  • Sell, publish or commercially exploit course materials.

  • Use course content to create or deliver their own teaching courses or workshops without written permission.

Customers are welcome to use the techniques and skills they learn to create their own original artwork, including artwork that they subsequently sell.

Cancellations and Refunds

Online courses provide access to digital content, and specific cancellation rules apply.

For UK customers, the Consumer Contracts Regulations 2013 generally provide a 14-day cancellation period for online purchases. Where a customer requests immediate access to a course before the end of this period, they will be asked to:

  • Expressly consent to the supply of the digital content beginning immediately.

  • Acknowledge that they will lose their statutory right to cancel once the digital content supply has begun.

Where these requirements have been properly met and access has begun, the statutory right to cancel simply because the customer has changed their mind will be lost. If the customer does not provide this consent and acknowledgement, their statutory cancellation rights remain in place. For customers outside the UK, any mandatory cancellation or withdrawal rights applicable in their country of residence will be respected. Where a customer no longer has a statutory right to cancel, refunds will not normally be available simply because they change their mind, decide not to complete the course or no longer wish to access it. Nothing in these Terms and Conditions affects statutory rights where digital content is faulty, not as described or does not meet applicable consumer protection requirements.

Technical Requirements

Customers will need a reliable internet connection, a suitable computer, tablet or smartphone and a compatible internet browser to access the courses. Customers are responsible for ensuring their devices and internet connection are suitable.

We will make reasonable efforts to help resolve technical problems relating to course access or materials.

9. Copyright and Intellectual Property

All original paintings, prints, photographs, written materials, course content, demonstrations and other creative materials produced by Jane Powell remain protected by copyright unless otherwise agreed in writing.

Purchasing an original painting, print, greeting card or online course does not transfer copyright or give the purchaser permission to reproduce the work commercially. Customers may not copy, reproduce, distribute, publish or commercially exploit any of Jane Powell's copyrighted work without prior written permission. This includes images displayed on the website, social media, course materials and promotional publications.

10. Limitation of Liability

Jane Powell Art takes reasonable care to ensure that products, services, workshops and courses are accurately described and provided to an appropriate standard. However, we cannot guarantee particular artistic or educational results from attending a workshop or completing an online course. We are not responsible for losses arising from circumstances outside our reasonable control, including interruptions to internet services, third-party platforms, postal services or courier services. Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence and any statutory consumer rights or remedies.

11. Privacy and Personal Information

Personal information is collected and used where necessary to process orders, manage workshop bookings, provide access to online courses and communicate with customers. Personal information will be handled in accordance with our Privacy Policy, available on our website:  www.janepowellartist.co.uk

We do not sell customers' personal information to third parties. Essential communications relating to purchases, bookings and courses may be sent by email. Marketing communications will be handled in accordance with applicable data protection and electronic marketing laws.

13. International Customers and Governing Law

Customers' banks or payment providers may apply currency conversion fees or international transaction charges. International customers are responsible for any applicable import duties, customs charges or local taxes arising from their purchases. These Terms and Conditions are governed by the laws of England and Wales. If you are a consumer living outside England and Wales, this does not remove any mandatory consumer protection rights that apply under the laws of your country of residence. Where a translation of these Terms and Conditions is provided, the English version will be used to resolve any inconsistencies, subject to any mandatory local legal requirements.

14. Changes to These Terms and Conditions

Jane Powell Art reserves the right to update these Terms and Conditions from time to time.
